This website www.analytics.ram.com.my (the “Website” or the “Site”) is owned by RAM Holdings Berhad and its affiliates (collectively or individually referred to as “RAM”).
The following terms shall have the meaning as specified:
Access to and the use of the Website and its Website Services/Content shall be conditional on your agreement to the Terms of Use. By using or visiting and continuing to access the Website including creating a User account, the User has indicated acceptance of the Terms of Use, to which all Users shall by be bound.
These Terms of Use govern the usage of the Website and Website Services/Content. Specific terms or agreements may apply to the use of certain services provided in the Website Services/Content and such terms shall prevail in the event of any conflict with the Terms of Use herein.
Except as expressly stated in the Terms of Use or otherwise permitted in writing by RAM, the User may not:
RAM reserves the right at any time and at its sole discretion to revise, update, change, alter and vary the Terms of Use and/or the Website Services/Content. The continued usage of the Website and Website Services/Content by Users following any such revision, update, change, alteration or variation shall constitute as the Users’ acceptance of, and agreement to such revision, updates, changes, alteration and/or variation to the Terms of Use.
Users acknowledge that all information, data, materials, reports, results, analyses, graphic and visual contents as well as any software programs available on or through the Website are protected by copyright and applicable proprietary and intellectual property laws. All rights, titles and interests pertaining to the Website and Website Services/Content are the sole property of RAM. The RAM’s name and its logo as well as the trade names of its products, are trademarks of RAM.
The use of certain portions of the Website and Website Services/Content may require a user password. As part of the registration process, the User who wishes to gain access shall select a member name and password and provide RAM with accurate, complete and up-to-date information. Accordingly, all Users must keep their password secret and secure. By agreeing to these Terms of Use, all Users shall be solely responsible for the confidentiality and use of their respective password, as well as for any communications entered through the Website using their password. As a condition of this use, all registered Users will notify RAM if they become aware of any loss or theft of their password or any unauthorized use of their password. RAM reserves the right to delete or change a password at any time and for any reason.
RAM reserves the right to seek any and all remedies available to it at law or in equity for any violation of these Terms of Use, including but not limited to the right to block a violating User's access from the Website and Website Services/Contents. RAM further reserves the right to determine whether or not a User has committed any violation of the terms and conditions herein.
The User shall comply with all applicable laws, rules, regulations and guidelines governing their duties, obligations and business practices, including but not limited to compliance with the Malaysian Anti-Corruption Act 2009, Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001, and any subsequent additions, amendments or revisions thereto, and shall obtain all approvals, consents, authorisations and licenses whatsoever which are deemed necessary for its operations.
If any User is in breach this Clause, in addition to any other rights or remedies RAM may have, RAM may immediately terminate User’s access to the Website and Website Services/Content.
These terms and conditions shall be governed by the laws of Malaysia and the User hereby submits to the jurisdiction of the Courts of Malaysia.
No failure to exercise, and no delay in exercising, on the part of either the User or RAM, any right or any power hereunder shall operate as a waiver thereof, nor shall any single or partial exercise of any right or power hereunder preclude further exercise of that or any other right hereunder.
